Domestic Violence can be verbal if a family or household member believes that the offender will cause imminent physical harm. No physical harm is necessary to be charged with this type of Domestic Violence and it is a lower level offense than actual physical harm. It is a misdemeanor of the 4th degree under Ohio law.
This charge may be cited with police at the same time as a menacing charge which is also a misdemeanor of the 4th degree. 30 days in jail are possible and although there may have been no physical harm inflicted, employers, family, and others will assume there was an injured victim. Make sure you get an experienced criminal attorney to help you understand your rights.
